Kinley is an AI wellbeing companion. She's designed to be a thoughtful presence: someone to check in with, reflect with, and think out loud to.

Kinley is not a medical professional, a therapist, or a mental health provider. Nothing she says is medical advice, a diagnosis, treatment, or a substitute for care from a licensed clinician. If you're dealing with a health concern, please talk to a doctor. If you're struggling with your mental health, please talk to a therapist or counselor.

Kinley is not a substitute for professional care. If you need medical, mental health, legal, or financial advice, please consult a qualified professional. Kinley can be a helpful thinking partner alongside professional care, but she shouldn't replace it.

If you're in crisis, please contact the Suicide and Crisis Lifeline by calling or texting 988 (in the US), or go to your nearest emergency room. Kinley is not equipped to handle emergencies. Kinley does not monitor your messages for signs of crisis, alert emergency services, or provide intervention. If you or someone you know is in immediate danger, please contact emergency services directly.

You must be at least 18 years old to use Kinley. By using the service, you confirm that you are.

Please don't:

• Use Kinley to harass, threaten, or harm another person.
• Send illegal content or use Kinley for illegal activity.
• Try to abuse, exploit, jailbreak, or reverse-engineer the service.
• Impersonate someone else, or share private information about another person without their consent.
• Use Kinley to generate spam or anything intended to deceive.

We reserve the right to suspend or terminate accounts that violate these rules.

Kinley reaches you over SMS and iMessage. By texting her, you consent to receive messages from Freckle Social Inc.

• Reply STOP to any Kinley message to opt out at any time. We always honor it.
• Reply HELP for help.
• Message frequency varies.
• Message and data rates may apply, depending on your carrier.

Anything you share with Kinley belongs to you. You grant us a limited license to store and process it solely to operate the service — sending replies, maintaining context across check-ins, and improving Kinley. We treat what you share with care; see our Privacy Policy for the details. This includes information you share about other people in your life — by sharing it with Kinley, you confirm that you're sharing it in your personal capacity and you're not violating any confidentiality obligations to those people. You're responsible for what you choose to share.

You can stop using Kinley at any time — reply STOP, or email us to delete your account. When you delete your account, we'll remove your phone number, message history, and conversation data within 30 days. Some information may be retained longer if required by law.

We may suspend or terminate your access if you violate these terms, abuse the service, or if we're legally required to. If it's not an emergency, we'll try to give you reasonable notice.

Kinley is provided "as is" and "as available." We work hard to keep her running, but we don't guarantee the service will be uninterrupted, error-free, or always accurate.

Kinley uses AI to generate responses. AI can be wrong, miss important context, or give bad advice. Treat what she says as input to your own thinking, not as authoritative guidance. Always use your own judgment, especially for important decisions.

To the fullest extent permitted by law, Freckle Social Inc. and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of Kinley. Our total liability for any claim relating to the service is limited to one hundred US dollars ($100).

Nothing in these terms limits liability that cannot be limited under applicable law.

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

If we have a dispute, please email us first at katie@joinfreckles.com so we can try to work it out. If we can't, any unresolved dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

We may update these terms from time to time. If the changes are material, we'll update the effective date at the top and let you know — by email if we have yours, and by posting a notice on this page. Continuing to use Kinley after a change means you accept the new terms.
